CBP Clarifies Section 232 Tariffs on Medium and Heavy-Duty Vehicle Imports

On October 29, 2025, U.S. Customs and Border Protection (CBP) released guidance to the trade community regarding the implementation of Section 232 import duties on Medium and Heavy-Duty Vehicles (MHDVs), their associated parts, and buses.

Effective November 1, 2025, additional duties ranging from 10% to 25% ad valorem will apply to MHDVs, parts and buses imported from all countries, depending on the product category.  Notably, CBP’s guidance also addresses the treatment of parts for passenger vehicles and light trucks with some excluded chapters.  These parts are subject to additional duties if certified by the importer of record on the customs entry for use in U.S. automobile production or repair.  MHDV parts originating from the United Kingdom, European Union, and Japan may be subject to reduced tariff rates.  CBP also outlined specific circumstances under which MHDVs, their parts and buses are exempt from other additional duties.

The guidance includes detailed Harmonized Tariff Schedule (HTS) provisions and an attached list of all classifications subject to this Section 232 action.

Foreign Trade Zones

Entries into Foreign Trade Zones (FTZs) are permitted; however, qualifying cargo must be admitted under “privileged foreign status”.

Drawback

Section 232 duties on applicable parts are eligible for Direct Identification Manufacturing Drawback and Substitution Manufacturing Drawback claims only.

Chapter 98

Goods entered under Chapter 98 provisions may still benefit from applicable duty exemptions or reductions.  However, Section 232 duties will still apply in addition to any Chapter 98 benefits.  Specifically, for entries under HTSUS 9802.0060 duties will be assessed based on the full value of the imported article, not just the value of foreign processing or components.
